Yakima County Prosecutor Joe Brusic has reached what he calls an extremely difficult decision in a high profile murder case. A man who admitted to shooting his wife will go free—for now.Here’s the statement from prosecutor Brusic:

Today, July 27, 2015, the Yakima County Prosecutor’s Office has formally decided to dismiss without prejudice the criminal charges pending against Cory Lindblom in State v. Lindblom, Yakima County Cause No. 14-1-01846-6.

Mr. Lindblom is currently charged with 2nd Degree Murder and 1st Degree Manslaughter with aggravators and enhancements.  Mr. Lindblom shot his wife on March 8, 2013 and was formally charged in December 2013 and brought back to Yakima County in January 2015 for his original arraignment.  Mr. Lindblom was tried by a jury in June 2015 which resulted in a hung jury.

The Yakima County Prosecutor’s Office has determined, after a full consideration of all factors and a weighing of potential future success at trial, that it is not pursuing the charges currently pending against Mr. Lindblom at this time.

This extremely difficult decision is made after full analysis of the facts as admitted in court and consideration of the previous jury verdict.  The State is always cognizant of public resources as well and in light of the risk of a possible self- defense finding by another jury, the State is choosing to ask the Court to dismiss without prejudice which would allow the State to re-file if new evidence comes to light.
