The city of Yakima has denied a request by KIT for crime scene videos related to a gang shooting in which a 30-year-old man was killed in November. KIT News requested all information and video from the investigation. While the city did provide dozens of police reports all videos that show the actual shooting have been withheld even though the investigation has finished. The videos from the scene and from police vehicles reportedly show, among other things the shooting outside the store in which 30-year-old Marcos Guillen was killed. Authorities say both Guillen and the suspects fired at each other during the shooting outside the store on November 20.

Three suspects were arrested in connection with the fatal shooting. But after an investigation the Yakima County Prosecutors office decided not to file murder charges against the three known gang members identified as 20-year-old Jonathan Lopez, 19-year-old Angel Garcia and 15-year-old Mickael Garcia. Police say before the shooting Guillen and the 3 others exchanged words and then fists. After the fight inside the store it continued outside with a gun fight between Guillen and the three other gang members.

Yakima Police forwarded reports to the prosecutors office saying the video clearly shows the 3 suspects were waiting for Guillen outside the store before shots were fired that killed Guillen. But you won't be able to make a judgement call on whether or not prosecutors were correct in not charging the suspects because the videos are not being made available to the public.

While no charges have been filed in the murder, prosecutors say if however more evidence is found in the future they'll consider charges in the case.
