37-year-old Anastaco Lepe, the suspect in last week's Safeway parking lot shooting, was released from jail last night. The Yakima County Prosecutors Office decided not to charge Lepe at this time. Lepe's lawyer told our news partner KIMA Action News that his client acted in self-defense in a dispute over Lepe's cell phone, and at this time police and prosecutors believe Lepe's story.

Lepe, who had an concealed weapons permit, shot twice when Partida stole the phone then reached for something that could be a gun. Yakima Police said the decision not to press charges came before they could talk to the victim, who is still in a Seattle hospital.
