The Yakima County Prosecutor's Office plans to drop its appeal against a man originally accused of murdering three people.

The prosecutor's office released the statement Thursday saying a recent Supreme Court ruling in another case would result in a dismissal of all charges against Kevin Harper, who they believe killed the Goggin family in their gated West Valley home in 2011.

The Yakima County Sheriff’s Office listened to privileged jail calls between Harper and his counsel. The prosecutor believes that would ultimately prevent them from a successful appeal.

In a plea deal, a judge sentenced Harper to more than nine years in prison for possession of a gun stolen from the Goggin home. In return the prosecutors agreed to drop aggravated murder charges against him.
