A federal judge has decided that U.S. House candidate Clint Didier's complaint against a campaign volunteer for opponent Dan Newhouse will be heard before the Nov. 4 election.

Attorneys on Wednesday argued over a motion Didier's campaign has filed against Chris Voigt, executive director of the Washington State Potato Commission, the commission itself and Newhouse's campaign.

The Tri-City Herald reports that U.S. District Judge Thomas O. Rice set an Oct. 29 date for a preliminary injunction hearing in Spokane.

Didier and Newhouse are both Republicans who are running for the U.S. House seat in the 4th District, covering central Washington.

Didier's campaign is complaining that the Newhouse campaign has used Voigt and the potato commission to raise money, as well as using a potato commission vehicle to put up Newhouse campaign signs.
