The Yakima city attorney says he believes the city has the right to ban pot sales under the state's legal marijuana law.

Jeff Cutter tells KIT News that he has prepared legislation for the Yakima planning commission on Wednesday before it goes to the city council.

“Both of those bodies can choose to adopt what’s been prepared as a draft or they can recommend changes be made to the draft.”

While there are concern among some council members that the city could set itself up for legal action if it moves to ban pot sales, Cutter says he is not concerned. He believes that the constitution protects the authority of the city to regulate and pass regulation that limits or controls certain uses.

The city council is expected to set a Jan. 21 hearing to deal with the proposal but first the issue needs to go before the planning commission Wednesday, Jan. 8.
